ROBOT CACHE MINING POOL TERMS OF USE
These terms of use (“Terms of Use”) govern your use of the Robot Cache Mining Pool and any related content and services (together, our “Mining Pool”).
You must have signed the Robot Cache Subscriber Agreement AND have a valid Robot Cache User Account to use our Mining Pool.
BY USING OUR MINING POOL, YOU ARE AGREEING TO BE BOUND BY AND TO FULLY COMPLY WITH THESE TERMS OF USE, OUR SUBSCRIBER AGREEMENT, OUR PRIVACY POLICY, OUR WEBSITES TERMS OF USE, OUR COMMUNITY GUIDELINES, OUR CONTENT POLICY AND OUR IRON POLICY AS THEY ARE SUBSEQUENTLY PROVIDED TO YOU (COLLECTIVELY, THE “RC TERMS AND CONDITIONS”). YOU FURTHER AGREE TO RECEIVE ALL NOTICES FROM AND TRANSACT WITH US ELECTRONICALLY.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE AND THE RC TERMS AND CONDITIONS, YOU ARE NOT AUTHORIZED TO ACCESS AND USE OUR MINING POOL, AND YOU MUST PROMPTLY CEASE ALL SUCH ACCESS AND USE.
DEFINITIONS
Blockchain is a type of decentralized ledger and continually updated list of transactions occurring across certain peer-to-peer networks. Blocks of transactions are validated and linked together by specific methods of cryptography. A blockchain can be used in a wide variety of ways, including the establishment of cryptocurrency and payment infrastructures, the authentication of digitally signed documents (proving identity), or the creation of verifiable records of business processes.
Boosts allow for a temporary increase in mining rewards which may vary in scope and duration.
Mining is the process of adding transaction records to a cryptocurrency public ledger of past transactions. This ledger of past transactions is called the blockchain (see above) as it is a chain of transaction blocks. The blockchain serves to confirm transactions to the rest of the peer-to-peer network as having taken place. Cryptocurrency nodes use the blockchain to distinguish legitimate transactions from attempts to re-spend coins that have already been spent elsewhere. Mining is intentionally designed to be resource-intensive and difficult so that the number of blocks found each day by those mining, the miners, remains steady. The primary purpose of mining is to allow nodes to reach a secure, tamper-resistant consensus. Mining is also the mechanism used to introduce new units of a cryptocurrency into the system. Miners are paid transaction fees as well as a granted a subsidy of newly created coins. These both serve the purpose of disseminating new coins as well as motivating people to provide security for the system. Mining requires access to computer hardware and software as well connection to the internet and entails a high level of power consumption.
Mining Pools pool the resources of multiple miners to solve blocks more quickly and split the rewards among the participants. Mining pools are available in a range of forms and arrangements as well as for different types of cryptocurrencies.
USING THE ROBOT CACHE MINING POOL
We have built our Mining Pool software into the Robot Cache Client software, which is available for download and installation via our Website (www.robotcache.com). By default, all mining is disabled, and you will need to Opt-In to allow mining to operate. You can also Opt-Out at anytime, using our Website or Client to Enable and Disable the Mining Pool.
Registration
Use of our Mining Pool requires that you register with us (https://www.robotcache.com/) prior to such use and agree to be bound by and fully comply with our subscriber agreement (“Subscriber Agreement”). The information you provide, if personal in nature or if automatically collected by us, will be subject to our Privacy Policy. You can find the terms of our Privacy Policy here.
Age REQUIREMENT
If you are a child under the age of 13 you may not use our Mining Pool, and parents or legal guardians may not agree to the Terms of Use on your behalf. If we become aware that a child under 13 has provided or attempted to provide us with personal information, we will use our best efforts to remove the information permanently from our files as provided in our Privacy Policy.
If you are under the age of 18 (or age of majority in your country of residence) but at least 13 years of age, you may use our Mining Pool with the prior approval and under the supervision of a parent or legal guardian who agrees to be bound by the Terms of Use. If you are a parent or legal guardian agreeing to the Terms of Use for the benefit of a child between the ages of 13 and 18 (or age of majority in your country of residence), be advised that you are fully responsible for his or her use of our Mining Pool, including all financial charges and legal liability that he or she may incur.
MININGPOOL REWARDS
Any rewards earned by you when you access and use our Mining Pool (including any Boosts) will be paid out to you in the equivalent amount of IRON, minus a fifteen percent (15%) Mining Pool fee which will be deducted from your IRON payment. We will deposit your IRON payments directly into your RC Wallet. Please see our IRON Policy for more information about IRON and RC Wallets.
Non-Commercial Use
Our Mining Pool is for your own personal non-commercial use only.
Additional Terms and Conditions for Software
When you use IRON to purchase any Robot Cache content or services, download or install or use any Robot Cache downloadable system software, or register for any Robot Cache services, you will be required to agree to, and be bound by, our Subscriber Agreement which may include additional terms.
Robot Cache Privacy Policy
Your use of our Mining Pool signifies your continuing consent to our Privacy Policy, which you can examine at any time by clicking here. Personal information that you supply to Robot Cache and any information about your use of Robot Cache that we obtain will be subject to our Privacy Policy.
Changes to MINING POOL
We may discontinue or change the features, functions, content, services, payment structure and policy of our Mining Pool (including Boosts) at any time with or without notice.
Proper Use of MINING POOL
You may use Robot Cache for lawful purposes only and may use our Mining Pool only in ways consistent with the law, these Terms of Use and the RC Terms and Conditions. You may not use any program, spider or "bot" to assist you in accessing or using our Mining Pool.
Proprietary Rights
Robot Cache and its suppliers and partners reserve all rights under intellectual property law in Robot Cache and in any content or technology that is in our Mining Pool and Boosts. Except as Robot Cache may expressly state in writing, you may not reproduce, reprint, publish, use, reverse engineer, compile, modify, or otherwise exploit content or technology from Robot Cache or its suppliers or partners in our Mining Pool without our express prior written consent.
Changes to OUR Terms of Use
We may change these Terms of Use at any time. You can review the most current version of the Terms of Use by clicking here. If you continue to use our Mining Pool (including any Boosts) after we make changes to the Terms of Use, you are signifying your acceptance of the new terms. You are responsible for checking these terms periodically for any changes.
Electronic Delivery Statement and Your Consent
You agree that we may provide to you notices and other information concerning Robot Cache or our Mining Pool electronically, including notice to any email address that you may provide.
No RESPONSIBILITY FOR ELECTRICAL COSTS OR COMPUTER DAMAGE
As mining can put significant demands on your computer hardware and software (e.g. CPU, GPU), the mining process can not only result in extremely high electricity costs, but some or all of your hardware and software components may be destroyed completely, including your data. Any such costs or damages are your sole responsibility. You must assess (and bear) the risk associated with such high electrical costs and potential for computer damage by yourself.
No GUARANTEE OF UPTIME
The uptime of our Mining Pool is not guaranteed, as maintenance and downtime may be required at times, or we may be the target of hacking or a computer virus, or experiencing a software or hardware malfunction.
Disclaimer of Warranties
We provide our Mining Pool and its content, Boosts, services, functionality and technology "AS IS." We and our suppliers, publishing partners and affiliates make no express warranties or guarantees about our Mining Pool. TO THE EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS, PUBLISHING PARTNERS AND AFFILIATES DISCLAIM IMPLIED WARRANTIES INCLUDING ANY WARRANTY THAT OUR MINING POOL WILL BE MERCHANTABLE, OF SATISFACTORY QUALITY, ACCURATE, TIMELY, FIT FOR A PARTICULAR PURPOSE OR NEED, OR NON-INFRINGING. WE DO NOT GUARANTEE THAT OUR MINING POL OR ANY RELATED CONTENT, SERVICES, FUNCTIONALITY OR TECHNOLOGY WILL MEET YOUR REQUIREMENTS, ARE ERROR-FREE, RELIABLE, OR WILL OPERATE WITHOUT INTERRUPTION. Because some states and countries do not permit disclaimer of implied warranties, you may have additional consumer rights under your local laws.
Limitation of Liability
You may not assert claims for money damages arising from your use of our Mining Pool. Robot Cache and our suppliers, publishing partners and affiliates are not be liable for any indirect, special, incidental, consequential or exemplary damages, even if we knew or should have known of the possibility of such damages. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised us of the possibility of such potential loss), damage caused to your computer, computer hardware, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. We are not responsible for any loss of digital coins which are stored in our Mining Pool. We shall not be obliged to compensate any losses due to theft of cryptocurrencies from the Mining Pool or temporary unavailability of the Mining pool. Cryptocurrencies are highly experimental crypto software, and as such, damages or loss of cryptocurrency arising from software errors therefore remain possible, and as we have no influence on the underlying cryptocurrency architecture, we shall not in any case be exposed to claims relating to such errors.
Indemnification
You agree to defend, indemnify, and hold Robot Cache and our parent and affiliated companies, and our respective employees, contractors, officers, directors, agents, publishers, and affiliates from all liabilities, claims, and expenses, including attorney's fees that arise from your use or misuse of our Mining Pool. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
International Use
We make no representation that any content, functions or features on our Mining Pool is appropriate or available for use in locations outside the United States. If you choose to access our Mining Pool from a location outside the US, you do so on your own initiative, and you are responsible for compliance with local laws.
Severability and Integration
The Terms of Use and any supplemental terms, policies, rules and guidelines posted on our Mining Pool constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Termination
We reserve the right to terminate your use of our Mining Pool in the event you violate the Terms of Use or any rules or guidelines posted in our Mining Pool or as set out in the RC Terms and Conditions or for any other reason in our discretion.
FORCE MAJEURE
In an event or circumstance which is beyond our control, including but not limited to acts of God, riots, wars, floods, fires, explosion, strikes and other similar events, we will not be held liable for any delay, failure or disruption to provide already committed mining services in our Mining Pool.
